ToxScan Terms of Service

In short: ToxScan gives you educational information about product ingredients, generated by AI. It is not medical advice and it can be wrong, so always read the actual product label and talk to a qualified professional about health decisions. Subscriptions are billed by Apple or Google, and you can cancel anytime in your store settings.

1. Agreement

These terms are a contract between you and Jonas Westh Creative, a sole proprietorship registered in Denmark (Bjørnø 12, 5603 Bjørnø, Denmark), the operator of the ToxScan mobile app. By downloading or using ToxScan you accept these terms. If you do not accept them, do not use the app.

You must be at least 16 years old to use ToxScan.

2. What ToxScan is

ToxScan scans consumer product barcodes, looks up ingredients in public product databases, and uses AI to generate a score, verdict, and explanation about those ingredients from a health-focused point of view. It is an educational tool for curious consumers. It is not a laboratory, a regulator, or a healthcare provider.

ToxScan is for informational and educational purposes only. It is not medical advice.

• ToxScan is not a substitute for advice from a doctor, dietitian, pharmacist, or any other qualified professional.
• Do not use ToxScan to diagnose, treat, cure, or prevent any disease or condition.
• Do not make medical decisions, or decisions about medication, pregnancy, or a child's health, based on ToxScan.
• If you have allergies or intolerances, never rely on ToxScan. Product databases can be incomplete or outdated. Always read the physical label on the product itself.
• If something in ToxScan worries you about your health, talk to a qualified professional.

4. AI-GENERATED CONTENT

ToxScan's scores, verdicts, flags, and explanations are automatically generated opinions produced by AI models, based on ingredient analysis and publicly available product data sources.

• They may be incomplete, outdated, or simply wrong. Databases contain errors, and AI makes mistakes.
• Product formulations change. The ingredients in the database may not match the product in your hand.
• Scores reflect ToxScan's own editorial philosophy about ingredients. They are a point of view, not a scientific measurement or an official safety rating.
• We make no warranty of accuracy. Verify anything important independently, starting with the label on the actual product, before relying on it.

5. Subscriptions and billing

• ToxScan offers auto-renewing subscriptions: currently about $39.99 per year (with a 3-day free trial) and $6.99 per month. Exact prices are shown in the app in your local currency and may change; changes apply from your next renewal.
• Payment is processed by Apple (App Store) or Google (Google Play), under their terms. We never see your payment details.
• Free trial: if you start a trial and do not cancel before it ends, it converts to a paid subscription automatically.
• Cancelling: cancel anytime in your App Store or Google Play subscription settings. Deleting the app does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies.

6. Acceptable use

You agree not to:

• use ToxScan for anything unlawful;
• copy, scrape, or bulk-extract ToxScan's content, scores, or data;
• reverse engineer, decompile, or interfere with the app or its servers;
• overload or abuse the service (for example with automated scanning);
• circumvent the free-scan limit or subscription requirement;
• present ToxScan's output as an official safety certification or as an endorsement by us.

We may suspend or block access that violates these terms.

7. Intellectual property

The ToxScan app, brand, design, scoring system, and content are owned by Jonas Westh Creative. You get a personal, non-transferable licence to use the app for your own non-commercial use. You keep ownership of photos you take; you give us permission to process them (transiently) to provide the service. Product data comes in part from third-party databases and remains subject to their own terms.

8. "AS IS" disclaimer

ToxScan is provided "as is" and "as available", without warranties of any kind, whether express or implied, including accuracy, completeness, reliability, fitness for a particular purpose, or uninterrupted availability. Your use of ToxScan is at your own risk.

9. Limitation of liability

To the maximum extent permitted by law:

• Jonas Westh Creative is not liable for indirect, incidental, or consequential damages, or for decisions you make based on ToxScan's output.
• Our total liability for all claims connected to ToxScan is capped at the amount you paid us in the 12 months before the claim arose.

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, such as liability for gross negligence or intent, or your statutory rights as a consumer in the EU. If you are a consumer in the EU, you keep every right that the mandatory consumer law of your country gives you.

10. Indemnification

You agree to indemnify and hold harmless Jonas Westh Creative from claims, damages, and reasonable costs arising from your misuse of ToxScan or your violation of these terms.

11. Termination

You can stop using ToxScan at any time by deleting the app (cancel your subscription first in your store settings). We may suspend or terminate access that violates these terms. Sections 3, 4, 8, 9, and 10 survive termination.

12. Governing law

These terms are governed by the laws of Denmark, and disputes belong to the Danish courts. If you are a consumer in the EU, you may also rely on the mandatory consumer protections of the country you live in and bring proceedings there. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

13. Changes to these terms

We may update these terms. We will update the date at the top, and if a change is significant we will let you know in the app. Continuing to use ToxScan after a change means you accept the updated terms.
